On Friday, February 16th, the Alabama Supreme Court issued a ruling that has dominated headlines since it was released. The ruling, concerning a case of two parents who utilized an IVF, or in vitro fertilization treatment facility in Alabama to conceive children, has led to many IVF clinics in the State of Alabama announcing that they will be pausing their services.
Within the ruling, the plaintiffs of the case reveal that they had contracted a facility called The Center for Reproductive Medicine to house embryos of their children, at subzero temperatures, for years, or even decades.
Several embryos were reportedly destroyed after an intruder broke into the clinic, and while attempting to steal the embryos from their subzero storage facility, dropped the embryos, killing them.
The ruling, which favored the plaintiffs, centered around an Alabama law called the ‘Wrongful Death of a Minor Act.’ This law protects unborn children, as well as children who have been born, which the Alabama high court stated multiple times in their ruling.
The controversial decision states, “the relevant statutory text is clear: the Wrongful Death of a Minor Act applies on its face to all unborn children, without limitation.”
Former President Donald Trump, who is the current front-runner in the Republican Primary field, and is favored to secure the Republican nomination for President, today called on the Alabama State legislature to protect IVF treatments in the State, saying, “We want to make it easier for mothers and fathers to have babies, not harder!“
